These logs are kept secure, are never used for marketing, and are retained only for short periods strictly to monitor server health, debug errors, and prevent malicious activity (Legal Basis: Legitimate Interest). We retain your account information and layout data for as long as your account remains active to provide our services.Your Data Rights: Under the GDPR, you have the right to access, update, or delete your data at any time. Furthermore, you have the right to restrict the processing of your data, object to processing, and withdraw any consent you have previously provided without affecting the lawfulness of past processing. To completely delete your profile and all associated data, navigate to the account settings panel in the editor and click 'Delete Account'. Upon doing so, your profile and hosted websites will be unpublished immediately. Please note that securely encrypted backups of your data may be retained for up to 30 days before being permanently and irreversibly wiped, strictly for disaster recovery purposes.Data Portability: You have the right to receive a copy of the personal data you have provided to us in a structured, commonly used, and machine-readable format (.json). 3. Payment Processing
All financial transactions are handled securely by our Merchant of Record, Lemon Squeezy. We do not store your credit card details on our servers; all financial data is processed securely through their encrypted systems (Legal Basis: Contractual Necessity).
4. Third-Party Sub-processors & International Data Transfers
We use secure cloud hosting and database service providers to store your website configurations and keep your hosted sites online. Currently, we utilize Vercel for our application hosting, Supabase for database management, and Upstash for rate-limiting. To ensure optimal performance, data may be processed on servers located outside the European Economic Area (EEA), including in the United States. When we transfer your personal data internationally (such as to Vercel, Supabase, Upstash, our authentication provider Clerk, or our payment processor Lemon Squeezy), we ensure it is protected by relying on recognized legal safeguards. These include the European Commission's Standard Contractual Clauses (SCCs) or relevant Adequacy Decisions, such as the EU-US Data Privacy Framework. We ensure all current and future sub-processors adhere to strict security standards to keep your data safe, and we may update our specific infrastructure providers in the future to maintain service quality.
5. Third-Party Services & Contact Forms
When you use our contact or support forms, the information you submit (including your name, email address, and message content) is securely routed and processed by our third-party form provider, FormSubmit. We use this service solely to receive and respond to your support inquiries. FormSubmit acts as a data processor, and your submitted data is not used by us for marketing purposes.
6. Local Storage & Cookie Disclosure
We do not use tracking or advertising cookies. However, we do use strictly necessary functional cookies (set by our secure authentication provider, Clerk) to maintain your active login session. Additionally, we use your browser's Local Storage to save functional UI preferences (like accessibility settings, language choices, and custom cursors) as well as non-identifiable interactive state. These technologies are strictly necessary for the platform to function properly and ensure a secure experience without tracking your identity across the web (Legal Basis: Legitimate Interest / Contractual Necessity).
7. Fonts & IP Privacy
To protect your privacy and ensure strict compliance with the GDPR, all fonts used on our website and the portfolio websites we host are served locally from our own servers. We do not use third-party font services (such as Google Fonts) that dynamically fetch assets and expose your IP address to external servers.
8. Website Analytics & Anonymization
We use a privacy-focused, self-hosted analytics solution (Umami) on our main website (the builder) to understand our overall visitor traffic and improve our service (Legal Basis: Legitimate Interest). This tool is specifically configured to discard and anonymize IP addresses, does not use tracking cookies, and collects no personally identifiable information. We strictly do not inject any analytics or tracking scripts into the individual websites published by our users.
9. External Links & Third-Party Platforms
Our platform contains links to external services and communities, such as Discord. Please be aware that once you click these links and leave our platform, your interactions, data, and privacy are governed by the respective privacy policies of those third-party services (e.g., Discord's Privacy Policy). We are not responsible for the privacy practices or content of external platforms.
10. Children's Privacy & Parental Consent
Our services are not directed to individuals under the age of 13, and we do not knowingly collect personal data from anyone under 13. Users between the ages of 13 and 17 may only use the platform with the explicit consent and supervision of a parent or legal guardian. We rely on the representations made by users during account creation regarding their age and parental consent. 4. Subscriptions, Billing, & Refund Policy
Access to live web hosting is provided via a recurring subscription, and all financial transactions are securely conducted by our Merchant of Record, Lemon Squeezy. By purchasing a subscription, you expressly consent to the immediate start of the digital hosting services and acknowledge that you thereby waive your statutory 14-day EU right of withdrawal. Because services are provisioned instantly upon successful payment, our platform policy is that fees are non-refundable. However, because Lemon Squeezy is the legal entity processing your payment, all billing disputes, chargebacks, and formal refund requests are ultimately governed by and processed in accordance with Lemon Squeezy's official policies. If a subscription is canceled or a payment fails, we reserve the right to unpublish the hosted website.
5. Intellectual Property & User Content License
You retain full ownership of the text and data you input. However, all pre-made assets (templates, images, audio, cursors, and designs) provided in the editor are our original creations and remain our exclusive intellectual property. We provide these assets "as-is" without any warranties, and you are granted a limited, non-transferable license to use them exclusively for websites built and hosted on our platform. You may not extract, download, redistribute, or resell our pre-made assets for use outside of Weboardies. By building and publishing a website on our platform, you grant Weboardies a worldwide, royalty-free, non-exclusive license to host, store, display, distribute, and technically modify (e.g., reformatting data for optimal performance across devices) your text, data, and overall website strictly for the purpose of operating, maintaining, and providing the service to you. We may take these actions at our sole discretion, without prior notice, and without liability for any refunds. Furthermore, to optimize platform resources, we reserve the right to delete free-tier accounts that have remained completely inactive (no logins to the editor) for an extended period (e.g., 12 months). We will attempt to notify you via email prior to permanently removing an inactive account.
8. Copyright & Intellectual Property Policy
Users are solely responsible for the content they publish. We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been published on a board without your authorization, please contact us immediately at . Because your boards are public, we strongly advise against including highly sensitive personal information on your website (such as home addresses, private phone numbers, financial details, or government identification). While you are welcome to share standard professional contact details, you do so entirely at your own risk. Weboardies is not responsible for how third parties may scrape, view, or use the information you choose to make publicly visible.
12. Service Availability & Force Majeure
While we strive to provide excellent uptime for all hosted websites, we do not guarantee uninterrupted access. Weboardies is not liable for service outages, data loss, or delays caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, severe cyber-attacks, or massive failures of third-party infrastructure (such as cloud providers or ISPs).
13. Service Modifications & Discontinuation
We are constantly innovating and may change, add, or remove features of the Weboardies platform at any time. Furthermore, while we hope to host your boards for a long time, we reserve the right to discontinue the service entirely. In the event of a total service discontinuation, we will provide users with at least 30 days' advance notice via email to allow you to export your text and data before the platform is taken offline.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that specific provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
